The Alberta Securities Commission is the industry-funded regulator responsible for administering the province's securities laws. It is entrusted with fostering a fair and efficient capital market in Alberta and with protecting investors. As a member of the Canadian Securities Administrators, the ASC works to improve, coordinate and harmonize the regulation of Canada's capital markets.

 

The Enforcement Division enforces Alberta securities laws by investigating, disrupting and prosecuting breaches of those laws with an eye for preventing and stopping current and future misconduct.

The opportunity

The successful candidate for the role of Senior Counsel, Litigation will be part of a team of professionals within the Enforcement Division. This position focuses on providing expert research support and advice to the Litigation department, ensuring that litigation and appellate matters can be analyzed and advocated effectively by the ASC based on knowledge of the law and awareness of current legal issues, risks and trends. This position also takes a primary role in collections matters, provides legal and strategic advice on litigation proceedings, both in court and before ASC panels, and acts as Litigation Counsel as needed.

Key responsibilities include

  • Conducting specialized legal research and analysis for cases proceeding to hearing, trial or appeal. 
  • Providing legal advice to the Director, Enforcement and managers within the division.
  • Monitoring developments in the law that affect Enforcement’s activities and communicating these developments (and their potential impact) to Enforcement colleagues and management.
  • Developing and facilitating sustainable research practices including overseeing the maintenance of legal research databases for use by ASC litigation counsel.
  • Drafting, reviewing and editing portions of written arguments, facta, or memoranda.
  • Collaborating with the ASC collections team and instructing outside counsel on civil enforcement matters, including related litigation and policy matters.
  • Participating as Litigation Counsel to resolve matters, pursue interim remedies or assist lead counsel in hearings and court proceedings.

The ideal candidate will possess

  • A law degree and be an active member in good standing with the Law Society of Alberta.
  • A minimum of 10 years of experience as a lawyer that includes conducting legal analysis, research, writing and litigation.
  • Recent experience in conducting electronic legal research for Canada and other commonwealth jurisdictions and the US.
  • Experience with civil enforcement proceedings.
  • Exceptional organizational skills.
  • Strong communication, analytical and time-management skills.
  • Knowledge of Alberta securities laws, administrative law, and recent jurisprudence.
  • Familiarity with the rules of evidence, Charter law, and experience with administrative law and/or criminal law practice.
  • Experience with knowledge management projects is considered an asset.

NOTE:  The successful candidate will be required to provide a Police Information Check with results satisfactory to the ASC prior to commencement of employment.
